South Carolina Lawmaker Reintroduces Bill to Exempt State from Federal Gun Ban

South Carolina Sen. Lee Bright (R-Spartanburg) has reintroduced a bill that would exempt any firearm, accessory or ammunition manufactured and kept within the borders of the Palmetto State from federal regulations.

Invoking states rights under the 9th and 10th Amendments to the U.S. Constitution, Bright’s legislation – known as the ‘South Carolina Firearms Freedom Act’ – states:

“A personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in South Carolina and that remains within the borders of South Carolina is not subject to federal law or federal regulation, including registration, under the authority of Congress to regulate interstate commerce.”

“Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition,” the bill adds.

      Not really, Montana did this same thing several years ago, had DOJ hopping mad, guess they couldn’t buy play like assault rifles and give them to the drug gangs in Mexicor

    States rights is the key to this tyranny!

    Secession and nullification are in order when you are facing an out of control tyrannical federal government such as this monstrosity that we are experiencing now.

    Our Founding Fathers made it perfectly clear that all Un Constitutional laws are null and void and should be treated as such.

      It’s pretty clear, by now, the Rule of Law in our nation has been replaced by the Rule of Executive Regulation. There’s a word for it – totalitarianism (Of, relating to, being, or imposing a form of government in which the political authority exercises absolute and centralized control)

    The single action of one State will not matter if the outcome is a Federal ban. Their claim would be for only weapons manufactured with in the State itself. There are several reasons why that will not work and be profitable. The first being cost. In a smaller markets so called Assualt weapons would be more costly to manufacture because of supply and demand. The single most important factor being those who already own these rifles, pistols, and shotguns. Will they be willing to purchace more to keep the market pricing low? I don’t think so. The second issue being of regulation of sales? So called straw buyers who would purchace weapons to be shipped into States that complied with the Federal ban. Once that happens the Fed’s will step in and shut it down claming the violation of Federal Law. The solution is a simple one if it can be accomplished. A large number of States need to create their own laws for the sale and distrubution or simply fight to keep the current laws in effect. As Gun owners people need to demand their rights and if necessary at the polls.

    Why not just submit a simply worded bill?

    “NO legislated law may supersede Constitutional Law, nor any of the Original 10 Amendments.”

    With the kicker penalty clause.

    “And attempt by any Elected official, law enforcement, or regulatory agent to enforce any unConstitutional law shall be subject to a minimum of 5 years in prison and/or $100,000(to be tied to the rate of inflation) for the first offense. Any more than one offense will result in automatic loss of Citizenship and LIFETIME probation.”

    That should weed out the big egos….

    Get that done in enough States and the government will suddenly begin to shrink due to inability to hire people willing to risk the penalties.
